We are committed to safeguarding your privacy and adhere to applicable laws and regulations, including the Personal Information Protection and Electronic Documents Act ("PIPEDA"), relevant provincial privacy laws, and health information privacy legislation. We believe transparency about how we handle your information is crucial to protecting your privacy.

Definitions

  • Assessment: An evaluation of treatment requests conducted by an Authorized Healthcare Professional through the Maxym Platform.
  • Applicable Law: Laws and regulations that apply to Maxym, Authorized Healthcare Professionals, and/or Users.
  • Authorized Healthcare Professional: Includes Physicians and Nurse Practitioners licensed in any Canadian province or territory.
  • Authorized Non-Practitioner Professionals: Regulated health professionals other than Physicians and Nurse Practitioners licensed in any Canadian province or territory.
  • Content: General health-related information available on the Maxym Platform that is not considered healthcare services and should not be relied upon as such.
  • Maxym Platform: Encompasses all hardware, software, applications, websites, content, products, and services owned or operated by Maxym for providing remote healthcare services and other purposes.
  • Personal Health Information (PHI): Identifiable health-related information about an individual, including health history and coverage eligibility.
  • Personal Identifying Information (PII): Identifiable personal details such as name, address, and phone number.
  • User: An individual registered to use the Maxym Platform.

How Maxym Collects and Uses Information

Below is an overview of how the Maxym Platform functions and the purposes for which we collect, use, and disclose User Personal Information (PHI and PII as needed). Details may vary depending on the Authorized Healthcare Professional and jurisdiction.

Healthcare Services

Authorized Healthcare Professionals collect Personal Information provided through the Platform, including details such as name, email, phone number, sex, date of birth, medical history, and emergency contact information. This information may be collected before assessments via forms, asynchronous chat, or video calls. Audio and video portions of assessments are not recorded. Authorized Healthcare Professionals may create records like prescriptions and assessment notes.

In cases of healthcare emergencies, Authorized Healthcare Professionals may contact your emergency contact if necessary. It is your responsibility to inform your emergency contact that you have provided their details to Maxym and to obtain their consent.

Maxym Pharmacy Network

Authorized Non-Practitioner Professionals gather Personal Information for users who choose to have prescribed treatments dispensed through the Maxym Pharmacy Network. This information may be collected via the Platform, telephone, or fax. Details may include name, email, phone number, sex, date of birth, mailing address, and medical history.

If you authorize a Third Party Payer to cover Fees for Healthcare Services or Other Services, you consent to Maxym disclosing your request for services to the payer and notifying them of any changes or termination of your access to the Maxym Pharmacy Network.

Third-Party Service Providers

Maxym employs third-party service providers for technical, operational, and marketing support. All third parties are contractually obligated to adhere to our privacy practices and this Policy.

Other Services

Maxym offers additional services to support healthcare delivery, such as handling lab test results, faxing prescriptions, and arranging medication delivery. Maxym may also provide other healthcare-related services delivered by Maxym Personnel or contracted third parties, all of whom undergo privacy and security training.

Additional Information Collection and Use

Maxym may collect and use information for various purposes, including:

  • Facilitating and managing User access to the Maxym Platform.
  • Tracking purchases and prescription refills.
  • Informing Users about relevant programs and services.
  • Collecting feedback and improving the Maxym Platform.
  • Complying with legal and regulatory requirements.

Personal Information Storage

Personal Information is stored at Maxym offices or our service provider's data centers in North America. The Maxym Platform is not intended for EU residents unless they reside in specific Canadian provinces. By using the Platform, you consent to the storage and processing of your information in North America.

Retention and Deletion of Information

Personal Information is retained at least until your account is closed. You can request a copy of your information for a limited period after account termination. We will securely delete information after this period, except where legally required to retain it.

Account Deletion

To delete your Maxym Account or specific information, contact us via email at privacy@maxymhealth.com. We aim to respond to requests within 30 days but will inform you if additional time is needed.

Accessing and Correcting Information

We strive to keep your Personal Information accurate and up-to-date. You can update or correct your information through your Maxym account, except for data created by Authorized Healthcare Professionals. For corrections, contact our customer service team or email privacy@maxymhealth.com

You may also request access to your Personal Information. We will respond to such requests within 30 days, subject to legal requirements. Complaints about our privacy practices can be directed to the Privacy Commissioner of Canada or relevant provincial authority.

Medical Record Retention

We retain Personal Information as required by law, with minimum retention periods varying by province. For details, consult the Medical Record Retention Schedule provided.

Disclosure of Information

Personal Information is shared with care, under specific circumstances, including:

  • With third-party service providers supporting our services.
  • During transactions involving the sale of Maxym.
  • To comply with legal obligations.

Maxym Pharmacy Network

Users opting for mailed prescriptions through the Maxym Pharmacy Network may have their information shared with shipping carriers for delivery purposes. We comply with relevant regulations, including PharmaNet in British Columbia.

Medical Record Disclosure

You can request access to your medical records within the retention period. Records may be disclosed based on your consent, and insurance coverage-related information sharing is your responsibility.

Lab Results

Lab results are collected for weight loss treatment plans, and Users consent to the disclosure of relevant information to laboratories. Coverage-related information sharing is the User's responsibility.

Consent for Collection, Use, and Disclosure

Consent is required when collecting, using, or disclosing Personal Information. Consent can be given orally, electronically, or in writing. You can withdraw consent by notifying us accordingly.

Accountability

Maxym is responsible for protecting your Personal Information, except in Alberta, where healthcare providers have primary responsibility.

Safeguarding Information

We implement various security measures to protect Personal Information but cannot guarantee complete security. We require our Personnel and third-party service providers to undergo privacy and security training and adhere to our policies.

Cookies and De-identified Data

We use cookies and other technologies to enhance the Maxym Platform. De-identified data is used for compliance monitoring and research but will not be used to re-identify Users.
