Terms of Use
Maxym Health ("Maxym," "we," or "us") last updated these Terms of Use ("Terms") on August 16, 2024. You can review the most current version of the Terms at www.maxymhealth.com. We may modify these Terms as needed to reflect changes in applicable laws, our practices, or the Maxym Platform. The Platform is accessible through websites and applications, including www.maxymhealth.com. It is advisable to check for updates to the Terms before using the Maxym Platform. Continued use of the Maxym Platform after any changes to these Terms implies your acceptance of the revised Terms.
Maxym Platform and Services
Maxym operates an information technology platform consisting of applications, websites, content, products, and services (collectively, the "Maxym Platform"). This platform allows registered users ("Users," "you," or "your") to access telehealth services provided by Authorized Healthcare Professionals (healthcare professionals licensed to practice in a Canadian province or territory) and other related health services.
Telehealth involves providing healthcare through interactive text, audio, and/or video technology when the patient and healthcare provider are not in the same location. These services, referred to in the Terms as "Healthcare Services," may include diagnosis, treatment, follow-up, and patient education, such as transmitting medical records and issuing prescriptions. Maxym also offers optional services at a User's request, including transmitting consultation summaries and prescriptions securely. Maxym might introduce additional services periodically.
By becoming a User, you consent to receiving Healthcare Services through the Maxym Platform. If you opt for a Maxym Pharmacy Partner to fulfill your prescription, it will be transferred within the Maxym pharmacy network for efficient processing.
Eligibility and Availability
The Maxym Platform is available only to residents in Alberta, British Columbia, Manitoba, Newfoundland and Labrador, Nova Scotia, Ontario, Prince Edward Island, or Saskatchewan. To use the Maxym Platform, you must:
- Be at least 18 years old,
- Have the legal authority to enter into a binding agreement,
- Register with Maxym.
Maxym is not responsible for any loss of content or failure to store or provide any content on the Maxym Platform. We reserve the right to modify or discontinue the Maxym Platform (or any part of it) at any time without notice and will not be liable for any changes, suspensions, or discontinuations.
Nature and Scope of Healthcare Services
Healthcare Services are provided exclusively by regulated professionals, such as Physicians and Nurse Practitioners, licensed in Canadian provinces or territories. Telehealth licensing requirements vary by province or territory, and Healthcare Professionals may not be located in your jurisdiction during consultations. We will display the jurisdiction of Healthcare Professionals during your consultation.
You may file complaints about Healthcare Services with the regulatory body in the province where the services were received. We recommend having a primary care professional and informing them of the Healthcare Services received. Maxym allows you to send summaries of your consultations to your primary care provider if desired.
Healthcare Services Terms of Use
By receiving Healthcare Services, you agree to the following:
- The Maxym Platform connects Users with Authorized Healthcare Professionals but does not provide Healthcare Services itself.
- Authorized Healthcare Professionals are independent and not employees of Maxym.
- These professionals are responsible for their medical services and decisions.
- They may refuse or discontinue services and cannot guarantee results.
- Risks are associated with telehealth, and details are outlined in Maxym's Privacy Policy and Health Consent documents.
- Healthcare Services are dependent on your location and must be requested only for yourself.
- Maxym Platform is not for emergency care. In emergencies, contact 911 or visit an emergency room.
- Certain symptoms and medications are excluded from Healthcare Services.
- Prescriptions are for personal use only, and medication issues should be addressed with your primary care provider or emergency services.
- Medications filled by Maxym's Partner Pharmacies are non-refundable if unclaimed or delivery fails.
Ownership and Proprietary Rights
All content on the Maxym Platform, including design, graphics, and software, is owned or licensed by Maxym and protected by intellectual property laws. Maxym retains all rights to the Maxym Platform and associated materials. Content from the platform cannot be reproduced or used commercially without permission. Unauthorized access or modification is prohibited.
No Unlawful or Prohibited Use
You agree not to misuse the Maxym Platform or its content, including avoiding unauthorized copying, framing, or use of automated means to access content. You may not bypass security features or use the platform for unlawful purposes.
Third-Party Websites
Maxym may link to third-party websites but does not endorse or guarantee their content or functionality. Accessing these sites is at your own risk.
Viruses
Downloading or viewing content from the Maxym Platform is done at your own risk. Maxym does not guarantee that the platform or content are free from harmful elements, and you are responsible for protecting your computer system.
Privacy and Information Disclosure
Personal information you provide is collected by Authorized Healthcare Professionals and detailed in our Privacy Policy. Review the Privacy Policy for information on how we handle your data.
Communication and Conduct
Maxym does not ensure the confidentiality of communications made through the platform. You agree to communicate with Registered Healthcare Practitioners only through the Maxym Platform.
Electronic Communication and Consent to Receive Calls and SMS Messages
By using the Maxym Platform, you consent to receive electronic communications from us, including operational messages. You also agree to receive marketing communications via SMS, with message and data rates possibly applying.
Account Security
You must keep your account details confidential, notify Maxym of any unauthorized use, and secure your account by logging out after each session. Maxym is not liable for losses due to security breaches.
Disclaimer and Limitation of Liability
Maxym is not responsible for content loss or failures in content storage and reserves the right to modify or discontinue the platform. The Maxym Platform and content are provided "as is" without warranties, and Maxym is not liable for any damages arising from its use.
Indemnity
You agree to indemnify Maxym against any claims or damages resulting from your breach of these Terms, legal violations, or use of the Maxym Platform.
Fees and Payment
Credit card information is required for card validation before accessing Healthcare Services. Maxym may validate your card and hold funds for fees. Any third-party payments do not involve Maxym's control.
General Provisions
These Terms represent the entire agreement between you and Maxym. Disputes will be governed by provincial and federal laws. If any part of these Terms is unenforceable, the remaining provisions remain valid.
